Will and Testament
Glossary
Administrator – a person who handles the estate of someone who has died without a will. This is appointed by the court.
Executor – the person named an will who is chosen to administer a deceased person’s estate
Hereditament – anything can possibly be inherited by someone
Inheritance – anything that is received by a relative of someone who has died, regardless of whether there was a will or not
Legacy – a gift of personal property that is given to somebody by orders of a will. This gift does not include real property
Mutual wills – wills written up, usually by spouses or legal “partners” that gives each person in the will the others estate in the event one dies
Probate – establishing the validity of a will so it can be administered when a person is deceased
Renunciation – giving up an inheritance of anything given in a will or voiding out any debt owed by the deceased
Testacy – when a person dies and has a written will
Widow’s election – the option of a widow(er) to accept what their deceased spouse has left to them in their will or accepting what she would receive by the laws of succession
